The headline changes
CMS-9897-F (published as the 2026 IDR Operations Final Rule) reduced the administrative fee to $15 per party per dispute, effective June 11, 2026, with a general effective date of August 3, 2026. It also finalized a limitation to batched determinations of 50 qualified IDR items and services.
- Administrative fee: $15 per party per dispute (a sharp cut from prior levels).
- Batching: a 50 qualified-item-and-service cap on batched determinations.
- Eligibility: a 5 business day eligibility review step is added.
- Payer registration and a phased IDR Gateway are introduced.
- Remittances must carry CARC/RARC codes; the cooling-off period drops from 90 to 30 days.
As of August 3, 2026
The rule rolls out in phases over roughly 26 months; some provisions (CARC/RARC, the Gateway) will not be fully operational until 2027. Treat any 'current rules' checklist as dated and refresh it against the latest CMS guidance.
Why the fee cut does not make filing free
A lower administrative fee reduces the cost of a single filing, but certified IDR entity fees still apply and vary by determination type. Under the 2026 schedule, certified IDR entity fees run roughly $425 to $800 for single determinations and $625 to $1,150 for batched determinations. A dispute that is dismissed on eligibility still consumes preparation time and non-refundable fees.
That is the operational point: the cost of a wasted filing did not go away. It moved. The team that catches an ineligible or mis-batched dispute before it is filed avoids the fee and the rework.
What to do now
- 1Map your current intake to the new 5 business day eligibility review so nothing sits.
- 2Rebuild batching logic against the 50-item cap and the same-payer/same-code rules.
- 3Confirm your remittance handling can read CARC/RARC codes as they roll in.
- 4Recalculate the cooling-off timeline against the 30 day window.
- 5Version and date your internal 'what changed and when' reference.
