IDR deadlines explained: the open negotiation and initiation windows
Most avoidable IDR losses are timing losses. A shared, tracked timeline is the cheapest insurance you can buy.

The windows, in order
Federal IDR runs on a sequence of deadlines: a 30 business day open-negotiation period, a short window to initiate IDR after open negotiation ends, certified IDR entity selection, and offer submission. Miss one and the dispute can be dismissed regardless of its merits.
Cooling-off changed
The 2026 Final Rule cut the cooling-off period from 90 to 30 days. Any timeline you built before mid-2026 needs re-checking against the current window (as of August 3, 2026).
Common failure modes
- Open negotiation started late or without a dated, written record.
- Initiation filed after the window closed.
- Batches assembled at the last minute and rejected on a technicality.
- No single owner for the clock across a team or across outsourced partners.
Deadline-control practices
- 1Give every dispute a single, visible timeline with the next action and its due date.
- 2Track cooling-off and initiation windows explicitly, not implicitly.
- 3Alert before, not on, the deadline.
- 4Keep a dated record of each step for the audit trail.
