Open negotiation is where clean disputes are won or lost

By the time a dispute reaches IDR, its record is largely fixed. Open negotiation is where you set that record.

Set the record early

The 30 business day open-negotiation window is not just a prerequisite; it is where you build the dated, documented record that later determines whether a dispute is even eligible. Sloppy or undocumented open negotiation is a leading ineligibility trigger.

A boundary worth respecting

Medicare benchmarking belongs here, not in IDR

Public-payer rates are prohibited factors in IDR under 45 CFR 149.510. Medicare-based benchmarking (for example, a REF-B-style reference) is appropriate only for open-negotiation context, never in an IDR submission. Keep the two clearly separated in your workflow.
