Why IDR disputes are found ineligible, and how to catch it before you file
Eligibility, not the merits, is where a large share of disputes die. The good news: most ineligibility triggers are checkable before you file.

The scale of the eligibility problem
Per the CMS Federal IDR Public Use File supplemental background for the last six months of 2025, the ineligibility rate declined to about 19 percent, while payers challenged the eligibility of roughly 42 percent of initiated disputes in that period. CMS itself has said the complexity of eligibility determination is the primary cause of processing delay.
The clock is the constraint
With a 5 business day eligibility review now in the process, a dispute that is missing a clean open-negotiation record or is mis-batched can be knocked out quickly. Catching it earlier is cheaper than defending it later.
The most common triggers
- State law or an all-payer model agreement governs the claim (not the federal process).
- Open negotiation was incomplete, undocumented, or outside its window.
- Cooling-off or initiation-window timing errors.
- Batching errors: mixing payers or codes, or exceeding the item cap.
- The item or service is not an eligible NSA item or service.
A pre-filing review workflow
- 1Confirm federal jurisdiction (rule out state/all-payer carve-outs).
- 2Verify a complete, dated open-negotiation record.
- 3Check every timing window against the current rule.
- 4Validate the batch against the 50-item and same-payer/same-code rules.
- 5Assemble permitted-factor evidence and record who reviewed it.
Where a readiness engine fits
Logic Refinery IDR-A supports this review with checklists, deadline tracking, and evidence templates. It does not decide eligibility for you, your named reviewer does.
